How long do I need to change my passport after marriage and how to do it right?
Registration of marriage is a happy event in the life of every girl. True, together with the new family status, in most cases, the surname also changes. Together with the surname, the passport, driver's license and any other official documents must be changed.
If there is time to wait with insurances and medical cards, then your main identification card needs to be changed right away. When it is necessary to do this, for how long and in which organ - is described in this article.
Reason for replacing a passport
The Family Code of the Russian Federation has an article 32. It regulates formal family relations, that is, the article states that after the registration of a marriage, both spouses have the right to change their name or leave the old one. Change of surname is an optional attribute of marriage. In addition, double surnames are also not prohibited by law.
Thus, only a change of surname of a citizen who has entered into marriage, or the use of a double surname can serve as an excuse to replace a passport after registration of marriage.
How long does it take to replace?
Most Russians believe that changing an identity card is too long a procedure that takes a lot of time and energy. Fortunately, it’s very different now. Replacement of this document occurs in the same mode as the replacement of a passport in case of loss, upon reaching age or upon its initial issue.
In Russia, there is Decree of the Government of the Russian Federation of 08.07.1997 N 828 (as amended on 11/18/2016) “On approval of the Regulation on the passport of a citizen of the Russian Federation, a sample form and description of the passport of a citizen of the Russian Federation”. This document regulates the timing of issuing a new passport. So, a new passport will be ready at the place of residence no more than 10 days later, and not at the place of residence, for example, at the place of residence - no later than 30 days from the date of acceptance of the documents.
When is it necessary to submit documents?
After the marriage is registered, the citizen who has changed his surname has a thirty-day period to submit the relevant documents for the change. But there is a nuance. The fact is that on the day the marriage is registered, the spouse’s surname will already be changed, and in the passport of the person who changed the surname, a stamp will be stamped by the registry office with the date of registration. In this regard, a passport with the current name is invalid and cannot serve as an identity document.
Turning to the same Decree “On the Approval of the Regulation on the Passport of a Citizen of the Russian Federation ...”, documents for replacing the passport must be submitted no later than thirty days from the date of registration of the marriage.
After a thirty-day period, the document becomes invalid, which is equivalent to incidents with a fake passport. Be careful.
Fines
If no documents were submitted within thirty days, a citizen with a new surname will be fined from 2 thousand to 3 thousand rubles, and living with an incorrect passport in Moscow and St. Petersburg will be punished by a fine from 3 thousand to 5 thousand rubles.
A citizen can avoid administrative responsibility in two cases:
- if the submission of documents has expired no more than 7 working days;
- if there is evidence that caused untimely appeal.
If a citizen fails to pay off the fine issued to him, one can wait for a more severe punishment, for example, arrest for 15 days, increase in the amount of the fine by 2 times or attraction of community service to 50 hours. These penalties are applicable for 2 years from the date of delay in payment.
In addition, due to the lack of a replacement passport or late payment of a fine, accounts may be seized or a ban on leaving the country may be imposed.
Documents required to replace a passport
As with any other change of identity card, the institution provides the necessary list of documents.
- Application for replacement of a passport in the established form (form No. 1P). The application should already indicate a new surname.
- Old passport, which is now to be replaced.
- Two photographs of the established size of 35x45 mm. If a temporary ID is required, then 3 photos are taken.
- The receipt of payment of state duty or the details of the receipt of payment.
- Documents required for marks in the new passport of the spouse. Documents of military registration, birth certificates of children under 14 years old.
And also to this list is added a certificate of registration of marriage. It is on its basis that the name will be changed.
Where to apply?
Usually, the FMS deals with the replacement of an identity card. They are divided into three divisions: by place of residence, place of stay and place of circulation.
Now the MFC and the Unified portal of state and municipal services are gaining more and more popularity. If you have to go to the FMS and the MFC yourself and personally submit documents, then thanks to registration on the Unified portal of state and municipal services, you can do everything online.
Personal visit
If you submit documents yourself, then you need to come to the necessary authority and submit the documents personally. Then they will tell you when you need to pick up your finished passport.
For a personal visit, you can ask for a temporary identification card on which your information will be indicated, he will be awarded a number, and the employee will also stick your photo and indicate the date by which this certificate will be valid.
Usually a temporary ID is issued for 10 days. Employees of government agencies are obliged to issue it to you at the first request, there are practically no cases of refusals in extradition.
Online
If you submit documents through the Unified Portal of State and Municipal Services, you will need to come in person only to receive a passport, taking with you the original documents.
Replacing a passport
In addition to the identity card of the Russian Federation, a citizen who has changed his surname must also replace other documents, including a foreign passport.
Of course, the issue with a foreign passport is not so strict as with the all-Russian or, for example, with rights. A spouse who has changed her last name may not have to change her passport before the deadline, if there are no planned trips to visa countries, the main condition in all forms is to indicate that this is her maiden name. Cases with EU countries or other countries where the order of entry has been tightened is more complicated. For example, when applying for a visa, you attach a copy of the documents of the passport of the Russian Federation, and if the data diverges, then the documents will not be accepted from you.
If the citizen nevertheless decided to change the passport, it will be necessary to pay a receipt for the passport of the old or new (biometric) sample.
What to do when immediately after registration you want to go on a honeymoon? There are no problems here, all documents are drawn up on old documents, and change after arrival back. Even if for some reason the honeymoon is delayed, you can provide tickets or a voucher for accommodation to cancel the fine.
Driver's license
A driver’s license is also optional. If during the verification you attach a marriage certificate to your existing rights, then there will be no problems.
Replacing other documents
In fact, it turns out that there are a lot of documents to replace. A new passport must be submitted to banks and tax authorities, as well as to a new landlord if you are renting an apartment. It is necessary to provide a new document for work and so on. Therefore, before changing the name, weigh the pros and cons, and then make a decision.
